Welcome to Elektrapop. This website is operated by LIVINGBREEZE LTD, a private company limited by shares, registered in England and Wales under company number 15932745, with its registered office at 232 Werrington Road, Stoke-on-Trent, England, ST2 9AW. Elektrapop is the trading name we use for our online store. Throughout these terms, "Elektrapop", "we", "us" and "our" refer to LIVINGBREEZE LTD, and "you" refers to anyone who visits our website or buys from us.

Please read these terms carefully before using our website or placing an order. By browsing our site or buying from us, you agree to these terms together with our Privacy Policy, Shipping Policy and Returns and Refunds Policy. If you do not agree, please do not use our website.

SECTION 1: USING OUR WEBSITE

You may use our website for your own personal, non-commercial shopping. By using it, you confirm that you are at least 18 years old, or that you are using the site with the involvement and permission of a parent or guardian.

We may update, suspend or withdraw any part of the website at any time, for example for maintenance or to fix errors. We will try to keep any disruption as short as possible, but we cannot promise the website will always be available or free from interruptions.

SECTION 2: OUR PRODUCTS

We specialise in women's clothing made from linen and other breathable natural fabrics. Natural fibres have their own character, so small variations in texture, slubs in the weave and slight differences in colour are a normal part of the fabric and not a fault. Linen also softens and may relax slightly with wear and washing.

We do our best to show colours and details accurately, but the colour you see may vary slightly depending on your screen. Measurements given in our size guides are approximate. If you are unsure about sizing, please get in touch before ordering and we will be happy to help.

SECTION 3: PRICES AND PAYMENT

All prices are shown in pounds sterling (GBP) and include any applicable taxes. Delivery charges, where they apply, are shown separately at checkout before you pay.

Payment is taken at the time you place your order. We accept the payment methods shown at checkout. Your payment details are processed securely by our payment providers, and we never see or store your full card details.

We occasionally make mistakes with pricing. If we discover that an item has been listed at the wrong price, we will contact you before dispatching your order and give you the choice to continue at the correct price or cancel for a full refund.

SECTION 4: YOUR ORDER AND OUR CONTRACT

When you place an order, you will receive an email acknowledging it. This email confirms that we have received your order but does not yet mean we have accepted it. Our contract with you is formed when we send you an email confirming that your order has been dispatched.

We may decline or cancel an order, for example if an item is out of stock, if there is an obvious pricing error, or if we cannot verify payment. If this happens, we will let you know and refund any money you have paid in full.

SECTION 5: DELIVERY

We currently deliver to addresses in the United Kingdom only. Full details of our delivery options, costs and timescales can be found in our Shipping Policy. Risk in the goods passes to you once they have been delivered to the address you gave us.

SECTION 6: CANCELLATIONS, RETURNS AND YOUR STATUTORY RIGHTS

As a consumer, you have the right to cancel your order within 14 days of receiving your items under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You also have rights under the Consumer Rights Act 2015 if an item is faulty, not as described or not fit for purpose. Nothing in these terms affects your statutory rights. SECTION 7: COMMENTS, REVIEWS AND FEEDBACK

If you send us comments, suggestions, ideas or other feedback, whether through our website, by email or on social media, you agree that we may use, edit and publish that feedback in any medium without payment to you. We are under no obligation to keep feedback confidential or to respond to it.

You agree that anything you submit will not infringe anyone else's rights, will not be defamatory, offensive or unlawful, and will not contain viruses or any other harmful code.

SECTION 8: PROHIBITED USES

You must not use our website:

to break any law or regulation, or encourage others to do so
to infringe our intellectual property or anyone else's
to harass, abuse, threaten or discriminate against anyone
to submit false or misleading information, including when placing orders
to upload viruses or any other malicious code
to collect or track other people's personal data
for spam, phishing, scraping or crawling
to interfere with or get around the security features of the website

We may suspend or end your use of the website if you break any of these rules.

Our website may contain links to other websites or offer tools provided by third parties, such as payment or delivery tracking services. We do not control these and are not responsible for their content, products or practices. Using them is at your own discretion and subject to their own terms.

All content on this website, including text, photographs, graphics, logos and videos, belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce or distribute any of it without our written permission.

SECTION 11: OUR RESPONSIBILITY TO YOU

If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure or our negligence. We are not responsible for loss or damage that was not foreseeable, or for any business losses, as our products are sold for personal use only.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights as a consumer.

SECTION 12: INDEMNITY

You agree to compensate us for any claims, losses or costs (including reasonable legal fees) that arise because you have broken these terms or misused our website, to the extent permitted by law.

SECTION 13: SEVERABILITY

If any part of these terms is found to be unlawful or unenforceable, that part will be treated as removed and the rest of the terms will continue to apply.

SECTION 14: ENTIRE AGREEMENT

These terms, together with the policies referred to in them, make up the whole agreement between you and us about your use of our website and any purchases you make.

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in the Scottish courts, and if you live in Northern Ireland, you can also bring proceedings in the courts of Northern Ireland.
